State Seeks Death Penalty in Homicide Case

Joey A. Marcak, 31, of West Plains was charged with two counts of first degree murder, among other felonies, in connection with the May 5 double homicide of Frankie Ziegler and Richard Kuntz. He has remained in custody on a $1 million bond.
On May 27, the State of Missouri filed a notice of intent to seek the death penalty against Marcak. Subsequently, the accused no longer has a bond. He will remain in custody unless his bond is amended a second time.
Marcak is scheduled for a preliminary hearing alongside his alleged accomplices, Kyla Croney and Levi Gunter, on July 7. All three will appear before the Hon. R. David. Ray in the Howell County Courthouse.
